Sex with a 16/17 Year Old

In Utah a person cannot have sexual intercourse with a 16 or 17 year old if that person is 10 or more years older than the 16 or 17 year old.  Anyone 10 or more years older than a 16 or 17 year who has sexual intercourse, oral sex, any type of penetration with any object or part of the 16 or 17 year old’s body, or touches the 16 or 17 year old in any sexual manner can be charged and convicted of unlawful sexual conduct with a minor, a form of statutory rape.  This category of statutory rape can result in a third degree felony or a class A misdemeanor.
