Forcible Sexual Abuse – In Utah a person can be charged with forcible sexual abuse if the victim was older than 14 years of age and the aggressor touched the private areas of the victim without the victim’s consent.  Forcible sexual abuse carries a second degree felony and in some cases a first degree felony if the aggressor caused the victim serious bodily harm.

Sexual Abuse of Child – A similar crime to forcible sexual abuse is sexual abuse of a child, which also is a second degree felony, and the only difference being that the victim must be less than 14 years of age.  Sexual abuse of a child, however, can be categorized as aggravated, which is a first degree felony.  Sexual abuse of a child becomes aggravated for a number of reasons including if the aggressor became friends with the child for the sole purpose of engaging in the abusive conduct or if the aggressor held a position of trust with the child.
