Poaching and Wildlife Crimes Defense
In Utah if you take any protected wildlife or any of its parts without a valid license, tag, permit, or other authority from the Department of Wildlife Resources (DWR) you can be charged with a fish and game crime commonly referred to as poaching, which can result in hundred of dollars of restitution fines as well as many hundreds of dollars more of court fines.
If you have poached wildlife you face having to pay restitution penalties. The type of animal will determine the amount of restitution you have to pay. So, for example, if you poach something like a bald eagle you are going to pay a lot more in restitution than if you poach a turkey. You can imagine that if you are charged with multiple counts of poaching because you have allegedly poached tens or hundred of animals you can be facing tens of thousands of dollars in restitution fines; and, that is on top of jail and/or prison time and other penalties.
There area number of animals that if poached will result in felony charges brought against you. Some of those animals include bison, bighorn sheep, rocky mountain goat, moose, bear, peregrine falcon, bald eagle, elk, cougar, golden eagle, river otter, and gila monster.
You can also be charged with a felony if you are convicted twice within seven years of taking protected wildlife.
